We operate the website https://staxxrewards.com (the "Site"), together with our quiz, results, emails, content, and other related services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

Staxx Rewards provides general educational information, comparisons, and illustrative calculations. Staxx Media is not a bank, card issuer, lender, credit-reporting agency, broker, investment adviser, financial planner, law firm, accounting firm, or tax adviser. The Services do not provide individualized financial, legal, tax, accounting, or credit advice and do not create a fiduciary, professional, or advisory relationship. You are responsible for evaluating your circumstances, reviewing official issuer terms, and obtaining qualified professional advice where appropriate.

These Legal Terms are a legally binding agreement between you, personally or on behalf of an entity ("you"), and Staxx Media, Inc. By accessing or using the Services, you agree to these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, YOU MAY NOT USE THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.

We may update these Legal Terms as described below. Continued use after an updated version becomes effective means you accept the updated terms, subject to any notice or renewed assent required by law.

The Services are intended for users who are at least 18 years old. Persons under 18 are not permitted to use or register for the Services.

Our services

The Services provide general educational information, comparisons, and illustrative reward calculations. Results depend on the information entered, products reviewed, source data, assumptions, and methodology in effect at the time. Results are estimates, not promises or guarantees. They may exclude or simplify interest, fees other than modeled annual fees, merchant-coding differences, taxes, returns, caps, exclusions, forfeiture, targeted offers, welcome offers, redemption values, transfer-partner availability, opportunity costs, and products outside our reviewed set.

The Services are intended for users in the United States. Users accessing them from elsewhere do so on their own initiative and are responsible for complying with applicable local law. The Services are not tailored to comply with industry-specific regulations such as HIPAA, FISMA, or GLBA, and may not be used in a way that would violate those laws.

Responsible borrowing, applications, and issuer decisions

Interest and fees can exceed rewards. Staxx Rewards does not recommend carrying a balance, spending more, or making unnecessary purchases to earn rewards. Pay on time and in full when feasible, consider the full cost of borrowing, and do not rely on a rewards estimate as a reason to open or use a card when borrowing costs may outweigh the benefit.

Taking the quiz does not request a credit report and does not itself affect your credit score. Applying for a credit card may authorize the issuer to obtain a credit report through a hard inquiry, which may affect your score. The issuer alone determines product availability, eligibility, approval, pricing, credit limits, rewards, and account terms. We do not guarantee approval or any credit outcome.

Product and offer information

Product terms, offers, and eligibility rules can change and may vary by applicant, channel, or location. Review the issuer’s current application page, pricing and terms, and rewards rules before applying or acting. We try to use reliable sources and update material information, but do not guarantee every term, image, offer, link, or result is complete, current, or available.

Intellectual property rights

We own or license the intellectual property rights in the Services, including original text, methodology expression, selection and arrangement, website design, code, graphics, and Staxx Rewards branding (collectively, the "Content"), as well as applicable trademarks and logos (the "Marks"). Issuer names, trademarks, and product artwork belong to their respective owners.

Subject to your compliance with these Legal Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable permission to access and use the Services for lawful, non-commercial, educational purposes.

Except as expressly allowed, you may not copy, reproduce, aggregate, republish, upload, post, display, encode, translate, transmit, distribute, sell, license, or otherwise exploit any Content or Marks without written permission or a legal right to do so.

User representations

By using the Services, you represent and warrant that you have the legal capacity to agree to these Legal Terms, are at least 18 years old, will not access the Services through unauthorized automated means, will use the Services only for lawful purposes, and will comply with applicable law. If you provide information that is untrue, inaccurate, not current, or incomplete, we may suspend or terminate access to the extent permitted by law.

Prohibited activities

You may not access or use the Services for any purpose other than the purpose for which we make them available. You agree not to:

• Violate law or another person’s rights; impersonate another person or organization; or submit unlawful, fraudulent, infringing, or harmful material.

• Interfere with the security, integrity, operation, access controls, or availability of the Services, or introduce malicious code.

• Use unauthorized automated means to access, scrape, harvest, crawl, copy, monitor, or extract substantial Content or data, except ordinary search-engine indexing that follows our published instructions.

• Circumvent rate limits, robots instructions, or protective measures; reverse engineer non-public portions except where applicable law prevents restriction.

• Copy, republish, distribute, sell, sublicense, frame, mirror, or commercially exploit substantial Services Content without written permission or a legal right to do so.

• Use the Services or their outputs to make automated credit, eligibility, employment, housing, insurance, or other consequential decisions about another person.

• Use the Services to create a competing database or service, or encourage another person to do anything prohibited by these Legal Terms.

User submissions

The Services do not offer public user posting. If you send feedback, a correction, question, or other material, you represent that you have the right to send it and that it does not contain unlawful material or unnecessary sensitive information. You grant Staxx Media a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and incorporate feedback to operate and improve the Services. This does not authorize us to publish private support, legal, accessibility, or privacy-request content as a testimonial or identify you publicly without permission.

Affiliate links and advertisers

Staxx Rewards may receive compensation when you use certain links or complete a qualifying action. Compensation may affect which offers are available and where an offer appears, but it does not change what you pay an issuer and should not change our reward calculation. We do not compare every card or offer in the market. Review our Affiliate Disclosure and How We Make Money page where available.

The Services may link to issuer and other third-party services. Staxx Media does not control an issuer’s application, decision, account, rewards, customer service, privacy, security, accessibility, availability, or content. Your use of an external service is governed by that party’s terms and notice. A link is not a warranty or endorsement.

Services management

We may, but are not obligated to, monitor the Services for violations of these Legal Terms; take appropriate legal action; refuse, restrict, or disable access where technologically feasible; and manage the Services to protect our rights, property, and users and support proper operation.

Privacy policy

We care about data privacy and security. Please review our Privacy Policy at https://staxxrewards.com/privacy. By using the Services, you agree to the Privacy Policy, which is incorporated into these Legal Terms. If you access the Services from outside the United States, your information may be transferred to and processed in the United States as described in the Privacy Policy.

Term and termination

These Legal Terms remain in effect while you use the Services. To the fullest extent permitted by law, we may deny access to or use of the Services, including blocking certain IP addresses, for violation of these Legal Terms, applicable law, or conduct that threatens the Services or others. Provisions that by their nature should survive will survive, including intellectual-property rights, disclaimers, liability limits, indemnity, disputes, and general terms.

Modifications and interruptions

We may change, modify, remove, suspend, or discontinue the Services at any time, subject to applicable law. We do not promise uninterrupted, secure, or error-free availability. We are not liable for losses caused by a Service interruption to the extent permitted by law.

Governing law

These Legal Terms and your use of the Services are governed by the laws of the State of New York, without regard to conflict-of-laws principles, except that mandatory consumer-protection law in your place of residence remains applicable where it cannot be waived.

Dispute resolution

Any lawsuit arising out of or relating to the Services or these Legal Terms must be brought exclusively in the state or federal courts located in Queens, New York, and you and Staxx Media consent to personal jurisdiction and venue there. Before filing a claim, each party will send written notice describing the dispute and requested relief and allow 30 days for good-faith informal resolution, unless immediate injunctive relief is reasonably necessary or law forbids this requirement. These Legal Terms do not include mandatory arbitration or a class-action waiver.

Corrections

The Services may contain typographical errors, inaccuracies, or omissions, including in descriptions, availability, pricing, promotions, offers, or other information. We may correct errors, inaccuracies, or omissions and change or update information at any time without prior notice, subject to applicable law.

Disclaimer

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." STAXX MEDIA DISCLAIMS ALL WARRANTIES THAT MAY LEGALLY BE DISCLAIMED, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. STAXX MEDIA DOES NOT WARRANT THAT THE SERVICES, RESULTS, PRODUCT TERMS, OFFERS, LINKS, OR CONTENT WILL BE COMPLETE, CURRENT, AVAILABLE, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.

Limitations of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, STAXX MEDIA AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, REWARDS, OPPORTUNITIES, SAVINGS, GOODWILL, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATING TO THE SERVICES OR THESE LEGAL TERMS.

TO THE FULLEST EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE LEGAL TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID STAXX MEDIA TO USE THE SERVICES DURING THE 12

MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) US $100. These exclusions and limits do not apply to liability that cannot lawfully be excluded or limited.

Indemnification

To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Staxx Media and its affiliates, officers, directors, employees, contractors, and agents from third-party claims, damages, losses, liabilities, judgments, costs, and reasonable attorneys’ fees arising from your unlawful misuse of the Services, your material violation of these Legal Terms, or material you submit that infringes another person’s rights. This section does not require indemnification for Staxx Media’s own unlawful conduct and does not apply where prohibited by law.

User data

We will maintain certain data that you transmit to the Services for managing performance, as well as data relating to your use of the Services. Although we perform routine backups, you are solely responsible for data you transmit or that relates to your activities using the Services. To the fullest extent permitted by law, we have no liability for loss or corruption of that data.

Electronic communications

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing, to the extent permitted by law.

California users and residents

If any complaint with us is not satisfactorily resolved, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210 or (916) 445-1254.

Miscellaneous

These Legal Terms, together with any feature-specific terms incorporated by reference, are the entire agreement between you and Staxx Media concerning the Services and supersede prior agreements on that subject. If a provision is unenforceable, it will be modified only to the minimum extent necessary and the remaining provisions will continue in effect. A waiver must be in writing and is not continuing. You may not assign these Legal Terms without our written consent; we may assign them in connection with a reorganization, financing, merger, acquisition, sale of assets, or by operation of law. Headings are for convenience only. Nothing creates a partnership, joint venture, agency, employment, or franchise relationship.
